These Terms & Conditions govern the purchase and delivery of book ad creative services provided by Richard Fenton, trading as Fenton Writes. By placing an order and submitting your project brief, you agree to these terms in full. Please read them carefully before purchasing.

1. Who We Are

Fenton Writes is a sole trader business operated by Richard Fenton, 40 Montreal Park, East Kilbride, G75 8LB, Scotland. We provide book ad creative services including video ads, static images, ad copy, and related digital assets for indie authors.

2. Services

We offer three packages — Starter, Full Package, and Series Bundle — the contents of which are described in full on our Book Ads That Stop the Scroll service page. Each package is a one-time purchase covering the deliverables listed at the time of purchase.

We reserve the right to update package contents at any time. Any changes will not affect orders already placed and paid for.

3. Placing an Order

An order is placed when you complete payment via Stripe on our website. You will receive an automated payment confirmation from Stripe. This constitutes acceptance of your order.

Work will not begin until you have submitted your completed project brief via the form on the Thank You page. The 5 working day delivery window starts from the date your completed brief is received, not from the date of payment.

4. Pricing and Payment

All prices are displayed in GBP and are inclusive of any applicable taxes. Payment is processed securely via Stripe. We do not store your card details.

Launch offer pricing is available for a limited number of orders. We reserve the right to withdraw promotional pricing at any time. Orders placed at promotional prices will be honoured at the price paid.

5. Cancellations and Refunds

Important: These are digital creative services. Under the Consumer Contracts Regulations 2013, you have the right to cancel within 14 days of purchase — unless you request that work begins immediately. By submitting your project brief, you are expressly requesting that work begins immediately and you acknowledge that you waive your right to cancel under the Consumer Contracts Regulations 2013.

Our cancellation and refund policy is as follows:

  • Before your brief is submitted: You may cancel your order for a full refund by emailing richard@fentonwrites.co.uk. Cancellation requests must be received before your brief is submitted.
  • After your brief is submitted (work in progress): No refund is available once your brief has been received and work has begun.
  • After delivery and revisions: No refund is available once final files have been delivered, regardless of whether revision rounds have been used.

If you are unhappy with your delivered creative, please contact us in the first instance at richard@fentonwrites.co.uk. We are committed to delivering work you are genuinely pleased with and will do our best to resolve any concerns within the scope of your included revision rounds.

6. Revisions

Each package includes a set number of revision rounds as stated on the service page (one round for Starter, two rounds for Full Package and Series Bundle). A revision round covers changes to text, timing, colour, or pacing within the existing creative concept. A revision round does not cover:

  • A complete change of creative direction or concept
  • Replacement of the book cover or core assets provided in the original brief
  • Changes requested after the final revision round has been used

Additional revision rounds can be requested at a flat fee, agreed in advance by email.

7. Delivery

We aim to deliver your completed creative files within 5 working days of receiving your completed brief. Delivery is by email to the address provided in your brief. Working days are Monday to Friday, excluding Scottish public holidays.

Delivery timescales are estimates. We will notify you if a delay is anticipated. We are not liable for losses arising from late delivery.

8. Your Responsibilities

You are responsible for ensuring that:

  • You hold all necessary rights to the book cover and any other materials submitted to us
  • The information provided in your brief is accurate and complete
  • You respond to any queries from us in a timely manner — delays in your response may affect the delivery timescale
  • Your use of the delivered creative complies with the advertising policies of any platform on which you choose to run ads

We accept no liability for any issues arising from inaccurate information provided in your brief, or from your use of the delivered files in a manner that breaches third-party platform policies.

9. Intellectual Property

Upon receipt of full payment and delivery of final files, you are granted a non-exclusive, perpetual licence to use the delivered creative assets for the purpose of promoting your book. This licence covers use on social media platforms, advertising platforms, and your own website.

Fenton Writes retains the right to display delivered work as portfolio samples and use it in promotional materials for the Fenton Writes service, including on the fentonwrites.co.uk website and social media. If you would prefer your work not to be used as a sample, please notify us in writing at the time of submitting your brief.

We do not transfer copyright in any underlying tools, techniques, or templates used to produce your creative. All intellectual property in those remains with Fenton Writes.

10. Limitation of Liability

Fenton Writes provides creative assets only. We make no guarantees regarding:

  • The performance of your ads on any platform
  • Sales, page reads, downloads, or any other commercial outcome resulting from use of the delivered creative
  • The continued availability or policy terms of any third-party platform including Facebook, Instagram, Amazon Ads, or BookBub

Our total liability to you in connection with any order shall not exceed the amount paid for that order. We exclude all liability for indirect, consequential, or special losses.

Nothing in these terms limits our liability for fraud, death, or personal injury caused by our negligence.

11. Privacy

Information you provide when placing an order and submitting your brief is used solely for the purpose of delivering your order and communicating with you about it. We do not sell or share your personal data with third parties, other than Stripe for payment processing. For full details, please see our Privacy Policy.

12. Complaints

If you have a complaint, please contact us at richard@fentonwrites.co.uk. We will acknowledge your complaint within 2 working days and aim to resolve it within 10 working days.

13. Governing Law

These terms are governed by the laws of Scotland. Any disputes arising from these terms or from services provided under them shall be subject to the exclusive jurisdiction of the Scottish courts.

14. Changes to These Terms

We may update these Terms & Conditions from time to time. The version in force at the time of your purchase applies to that order. We will publish the updated date at the top of this page whenever changes are made.
